High court judge accused of judicial plagiarism for the 3rd time

High Court judge Wilson Chan has been accused of judicial plagiarism after the Court of Appeal overturned one of his rulings, saying large portions of his judgment were copied from a litigant's legal submissions.

The latest case involves a legal dispute between Koo Ming-kown, founder of Nam Tai Electronics and his former brother-in-law for not giving up 40 million dollars in shares.

The judge dismissed the plaintiffs' claim in 2024.

The plaintiffs later appealed.

In its judgment, a three-judge Court of Appeal panel says nearly 95% of Chan's written ruling had been copied from the opening and closing submissions of the defendant -- the former brother-in-law.

The appeal court says the judgment failed to demonstrate the judge had considered conflicting evidence or submissions from both sides.

The case was ordered to be reheard by a different judge.

The case marks the third time Justice Chan has faced allegations of judicial plagiarism.
